How do I choose a UK Rep?

You must have a representative if your company conducts business in the EU (EU GDPR article 3(2)). This requirement applies regardless of whether or not you have offices in Europe. If you have no offices in the EU yet do business in the EU you'll need an EU and UK representative unless you process very limited personal data of EU citizens. This would be the case when you provide products or services to EU individuals or monitor their actions.

If you are a non-EU company that offers products or services to EU subjects or monitors their conduct you must appoint a representative in the UK (UK GDPR Article 27). This requirement is applicable regardless of whether you're a controller of data or processor. The UK representative should be able represent your business in relation to your obligations under GDPR and also act as a point of contact for individuals and the ICO.

The UK representative needs to be a company or organisation established in the EEA and be capable of representing your company in relation to its obligations under the GDPR. This is typically an independent law firm. However it could also be a private firm or a consultancy. You can make the contact information of your representative easily accessible to EEA data subjects by publishing or including them in privacy notices. This allows EEA-based data users to reach out to the representative regarding their concerns with your business's handling of their personal data.

You must appoint a representative in writing, and you should outline the conditions of your relationship with them. This is similar to become a rep service contract. It is important to keep in mind that the appointing party remains accountable and accountable to the activities of its representative. This is especially true following the recent Rondon 2021 EWHC1427 judgement.

There are exceptions however they are extremely specific and rarely apply. Public bodies and authorities and companies whose processing is occasional and at low risk, are exempt from this requirement. However, even if an exception applies to you, it should be carefully considered to ensure that the obligation under the GDPR is still satisfied.

Article 27 of the GDPR specifies the duties of the UK Rep. This requires that all companies outside the EU or those that provide products and services to, or monitor the behavior of people in the UK designate representatives to act as a contact person for the ICO.

A UK rep is essentially the same as an EU authorized representative (EUAR) except that it is only applicable to the United Kingdom only. EUARs are accountable for monitoring compliance, and providing information to MHRA.

Experience of working and travelling internationally is typically required for these positions. The company they work for could oversee them and provide them with performance reviews. They may also receive an amount of money for bookings they make. The exact commission can vary, but is usually a percentage of the tour operator's profit.
